Death By Dangerous Or Careless Driving

A person who causes the death of another person by driving a mechanically propelled vehicle dangerously on the road or a public place is guilty of an offence. 

This is when the standard of driving falls far below of what would be expected of a competent and careful driver and it would be obvious to another careful and competent driver that this would be dangerous. This will also be the same if the vehicle is faulty and it is obvious that driving the vehicle in such a state would be dangerous.  

A person who causes the death of another person without due care or attention, or without reasonable consideration for other person using the road or place is guilty of an offence.  

This is when a when the standard of the driver falls below of what would be expected of a competent and careful driver. Consideration will be given to the circumstances of which the defendant could be expected to be aware of and circumstances shown to have been within the knowledge of the defendant.
