Dangerous Or Careless Driving

Careless driving can only be tried in the Magistrate’s Court. This is when a person drives a vehicle on a road or public place and where the standard of the driving falls below a competent and careful driver. The court will take into consideration the circumstances within the knowledge of the defendant and the circumstances he could be expected to be aware of.

Dangerous driving can be tried in either the magistrate’s court or the crown court. Any person who drives a mechanically propelled vehicle dangerously on a road or other public place is guilty of an offence.

This can arise if a person is driving dangerously or driving a vehicle which is in a dangerous condition. This would be the case if the way the person drives falls far below of what would be expected of a competent and careful driver and it would be an obvious to competent driver that driving in that way would be dangerous.
