A person is guilty of this offence if they are driving a motor vehicle after consuming so much alcohol that the proportion in the breath, blood or urine exceeds the prescribed limit.
The offence is one of strict liability and committed simply by driving on a road or in a public place with alcohol above the prescribed limit, or attempting to drive on a road or a public place with alcohol above the prescribed limit.
Prescribed limit: Breath: 35 µg of alcohol in 100ml of breath. Blood: 80 mg of alcohol in 100ml of blood. Urine: 107mg of alcohol in 100ml of urine.
